Florida Car Accident Statistics

The National Highway Traffic Safety Administration reported the following car accident statistics for Florida in the year 2018:

  • There were over 3,100 traffic fatalities
  • 814 of these fatalities were related to alcohol-impaired driving
  • 303 fatalities were a result of speed-related accidents

It is estimated that in 2017 over 1,000 lives were saved due to use of seatbelts.

What Is the Graves Amendment?

When filing a claim for personal injury after a car accident or other traffic accident, it's important to note the Graves Amendment or "vicarious liability law." This is an important part of Florida accident law that may apply to your circumstances, especially in a tourism heavy state like Florida.

Vehicle rental companies may not be held liable for accidents caused by drivers who were renting their vehicles including those that rent:

  • Cars
  • Vans
  • Limousines
  • Moving trucks
  • And other vehicles

Florida Injury Law Firm can maximize your compensation while keeping this amendment in mind.

What Are Florida's New PIP Laws?

Also, as of January 1, 2013, Florida's personal injury protection (PIP) laws have changed. Before, motorists were required to have at least $10,000 in PIP coverage in case they are injured in an accident that their own fault. That amount has now been lowered to a mere $2,500.

PIP coverage used to allow motorists an unlimited amount of time to receive treatment and still be covered, but the changes to the laws now allow only 14 days for a motorist to receive covered treatment for injuries. Additionally, massage therapy and acupuncture treatments are no longer covered through PIP insurance.

What Is the Florida Statute of Limitations for Car Accident Lawsuits?

According to Florida Statutes section 95.11(3)(a), those wishing to file a personal injury lawsuit for their car accident must do so within 4 years of the date of their accident.

The same law applies for individuals filing lawsuits over vehicle damage. The only case in which this deadline may change is if someone was killed in the car accident and you wish to file a wrongful death lawsuit on their behalf.

Wrongful Death Statute of Limitations

In this case, you would have up to 2 years following the date of the individual's death to file your claim. Failure to comply with Florida's statute of limitations will most likely lead to your case being dismissed.

What Kinds of Damages Can You Recover For Car Accident Injuries?

If you’ve suffered injuries from a car accident, you may be able to recover several types of damages. At the top of the list are medical expenses, but you may also claim damages that can’t necessarily be quantified – such as pain and suffering.

Medical Expenses

If you’ve been involved in a car accident, your injuries can be as minor as a few bruises and some soreness or as serious as head trauma, internal bleeding or permanent disability. Some of these injuries require around-the-clock medical care, which can quickly escalate your costs.

Medical expenses caused from car accidents can include:

  • Ambulance fees
  • Permanent disability
  • In-home services
  • Physical or cognitive therapy

Lost Wages

Some injuries sustained in a car accident may keep you from returning to work in a timely manner, resulting in a loss of work wages. Injuries that require continuous care may cause you to step out of work for doctor and physical therapy appointments. In regards to lost wages, you must prove that the injuries you suffered hinder on your ability to earn money in the future.

Pain and Suffering

In addition to mental or physical distress, pain and suffering damages can also include emotional suffering caused directly by the car accident. Pain and suffering is based on the type of injury, its seriousness and any future pain that is associated with the injury.

Loss of Affection or Companionship

Some injuries can deprive you and a spouse of the ability to show affection, also known as “loss of consortium.” This type of damage is unlike others in that it is claimed by the uninjured spouse, but the damages cannot be recovered if you don’t recover damages for your own injuries.
